The family of an 11-year-old class 5 pupil at Kisayani primary school in Kitui county is seeking justice after reportedly being beaten by a teacher administering corporal punishment.
Joshua Douglas Mutua’s left hand was broken while receiving corporal punishment from his teacher Priscilla Oirere for touching her car on the 22nd of February 2021, the boy claims.
His mother Grace Douglas says the boy was dismissed without first aid care. Her efforts in search of justice for her son were rendered futile.
She reported her case at Nzambani police station, and later to Nzambani Sub-County but did not get help. She later decided to approach the County Director but says she did not get help.
The government banned corporal punishment in Kenyan schools in 2001 and enacted the children’s act chapter 141 which entitles children to protection from all forms of abuse and violence.
The law states that a child shall be entitled to protection from physical and psychological abuse, neglect, and any other form of exploitation including sale trafficking or abduction by any person. Section 2 says that any child who becomes the victim of abuse in the terms of subsection 1 shall be accorded appropriate treatment and rehabilitation.
