TSC Salary Overpayment Recovery Strategy (Steps)

“Financial management is typically a critical aspect when it comes to carrying out the responsibilities of the Teachers Service Commission in managing teachers within the education system.

Within the teaching profession, the Commission places significant importance on integrity, accountability, and high ethical standards in the performance of duties and the reporting of any erroneous payments or adjustments leading to excessive salary payments.

In situations where a teacher becomes aware of an overpayment made by the Commission, it is the Commission’s responsibility to determine the appropriate procedures for recovery and the ensuing consequences.

The employer of teachers will employ various strategies to recover overpaid funds from teachers who do not raise concerns.

TSC Overpayment Recovery Methods:

1. The Commission recovers at least one-third of the basic salary from all employees on the payroll, ensuring that each employee retains one-third of their basic salary as their net pay.

2. TSC recovers all outstanding overpayments from salary arrears and any remaining balance through the payroll.

3. TSC may adjust the rate of recovery of salary overpayment through pay increments or salary adjustments.

4. Upon the discovery of an overpayment, TSC notifies the employee using a demand letter.

5. TSC initiates proceedings to recover salary overpayments from employees who have left the service.

6. TSC may recommend write-off for any overpayments that are deemed irrecoverable under section 157 of the Public Finance Management Act, 2015.

TSC’s recovery of salary overpayments includes the Commission Secretary being satisfied that:

– Reasonable steps have been taken to recover the losses, and the loss is unrecoverable.

– Further efforts to recover the loss would be uneconomical.

– It is in the Commission’s interest to settle the claim or waive it.

In case a TSC employee bearing the burden of overpayment leaves the service before full recovery, the outstanding amount becomes due and must be paid according to government regulations.

Regarding Criminal Proceedings:

Any individual found guilty of causing an overpayment or failing to report one will be reported to state agencies and other institutions for necessary criminal proceedings. These circumstances are considered a crime.”
