TSC Salary Overpayment Recovery and Sanction Strategies.

Financial management remains the sensitive factor in execution of TSC mandate in the teacher management.

The commission regards integrity, accountability and high ethical standards in Performance of duties and reporting of any incorrect payments or changes leading to salary overpayment.

Once the commission has made an overpayment to the teacher’s account, its the role of the commission’s management to determine the necessary recovery procedures and the consequences thereafter.

During the recovery process, the commission shall adopt different strategies in recovering the overpaid money.

TSC Overpayment Recovery Strategies

  • Recovery of the salary overpayment of at least â…“ of the basic salary for all the employees on the payroll and ensuring each employee retains â…“ of their basic salary as their net pay.
  • Full recovery of all outstanding overpayment from salary arrears and any balance thereof through the payroll
  • Use pay increment and/or salary adjustment to adjust the rate of recovery of salary overpayment.
  • Notifying employee upon discovery of any overpayment by use of a demand letter.
  • Initiating proceedings to follow up salary overpayment from employees who have exited Service.
  • Recommending for write-off for any irrecoverable overpayment per section 157 of the publicly finance management Act, 2015. These shall include the commission secretary being satisfies that;

– Reasonable steps are taken to recover the loses and that the loss is irrecoverable.

– Further Efforts to recover the loss would be uneconomical

– It would be to the advantage of the commission to effect a settlement of its claim or waive the claim.

You should note that if the employee shouldering the overpayment burden is exits the service before full recovery of the money, the outstanding amount becomes due and should be payable per government regulations.

Criminal Proceedings

Anybody who causes an overpayment or does not report an overpayment shall be reported to the state agencies and other institutions of criminal Proceedings for necessary action.
