TSC Procedure of Terminating Teacher’s Services; PnP & Probationary

In Kenya, there are specific rules and regulations that govern the process of ending a teacher’s employment.

Whether a teacher is on a temporary, probationary, or permanent and pensionable (P&P) contract, there are established procedures for ending their employment, as agreed upon by teachers and the Commission.

This article offers insights into the termination process and its implications for teachers in various employment categories.

Termination on Temporary or Probationary Contracts:

For teachers on temporary or probationary contracts, either the Commission or the teacher can initiate the termination of their employment. In such cases, a written notice of one month is required from either party before the termination takes effect. Alternatively, they can choose to provide one month’s basic salary as compensation instead of giving notice.

Additionally, teachers on temporary contracts who contribute to the National Social Security Fund (NSSF) will have their benefits handled according to the NSSF Act, Cap. 258.

Termination on Permanent and Pensionable (P&P) Contracts:

Teachers on P&P contracts, which offer greater job security, follow different termination procedures. The termination of such contracts can be initiated by either the Commission or the teacher. However, a longer notice period is needed in this case.

Both parties must provide a written notice of three months or pay one month’s basic salary as an alternative to notice for termination.

Refund for Male Teachers Under WCPS:

Male teachers who were contributors to the Widows and Orphans Pension Scheme (WCPS) are eligible for a refund of their contributions upon termination or resignation from service. This provides financial support to teachers who have been part of WCPS during their teaching careers.

Conclusion:

Understanding the termination procedures is crucial for teachers in Kenya, as it facilitates a smooth transition when their employment ends.

Regardless of whether teachers are on temporary, probationary, or permanent and pensionable contracts, they and the Commission must adhere to the specified notice periods and payment terms outlined in their respective agreements.

Furthermore, male teachers who contributed to WCPS can anticipate receiving a refund of their contributions upon termination. These regulations serve to safeguard the rights and financial well-being of teachers throughout their careers.
