KUPPET Top Official Rubbish Senate Petition On Retirement Age
The Kenya Union of Post-Primary Education Teachers (KUPPET) is currently facing a challenge regarding the retirement of its leadership, as raised by one of its members, Elias Masika. Masika contends that some of the Union officials have exceeded the mandatory retirement age and should not hold their positions. He argues that KUPPET’s retirement age of 65 is unconstitutional.
Masika’s primary concern is whether union executives, both at the national and branch levels, should be permitted to continue serving in their roles after reaching the mandatory retirement age. He believes that KUPPET is meant for active teachers and should not include retirees, those who have changed employers, received promotions, or taken on roles where they are no longer employed.
In contrast, he highlights that the majority of teachers’ representatives, both nationally and at the branch level, are retirees. Masika cites Section 12(b) of the union constitution, which specifies the retirement age of 65 for union officials. He argues that this age requirement is unfair, illegal, discriminatory, and disregards the needs of working teachers. He questions how retired officials can effectively assist teachers still in active service.

Masika has requested KUPPET Secretary General Akelo Misori to provide the Senate with the ages and retirement dates of all elected KUPPET officials. He also believes that union officials should not act independently by defying the mandatory retirement age and the PSC (Public Service Commission) Act of 2017, as they are part of the larger national governance structure.
Misori, on the other hand, dismisses Masika’s claims, suggesting that he should familiarize himself with the Union’s constitution and its requirements for becoming a union official. He asserts that only the High Court has the authority to address any grievances concerning the Union, and according to the law, anyone with teaching experience is eligible to lead KUPPET in any capacity.
