Diploma Holders in Engineering Barred from Taking Gov’t Projects

Lands Cabinet Secretary Zachary Njeru has recently introduced amendments to the National Construction Authority Act of 2011, focusing on the registration and involvement of construction technicians. These amendments, unveiled in Tuesday’s publication, introduce qualifications and limitations for contractors working on various project scales.

Firstly, contractors with a bachelor’s degree or higher qualifications will be eligible for projects valued at Ksh750 million or more. Building contractors holding diplomas will have the green light for projects ranging from Ksh100 million to Ksh500 million. Certificate holders are approved for projects worth Ksh50 million, while those with trade certification can work on projects valued at Ksh20 million or less.

The primary objective of these amendments, known as the National Construction Authority (Amendment) Regulations 2023, is to align with evolving industry norms, qualifications, and standards in response to developments in the construction sector. Notably, these changes shift the emphasis from document-based criteria to experience-based evidence, enabling the authority to more effectively assess the technical competencies of applicants.

In the field of civil engineering, engineers with bachelor’s degrees are authorized to engage in projects ranging from Ksh1.2 billion to Ksh2.5 billion, while diploma holders are limited to projects not exceeding Ksh750 million. Engineers with Trade Test qualifications are limited to projects under Ksh20 million, while Certificate engineers are restricted to projects up to Ksh50 million.

For electrical engineering services, regulations dictate that bachelor’s degree holders can undertake projects exceeding Ksh75 million, while diploma holders are confined to projects between Ksh10 million and Ksh40 million.

In the realm of mechanical engineering, which encompasses tasks such as plumbing and air conditioner installation, certification and trade test specialists are excluded. Bachelor’s degree holders are allowed to work on projects exceeding Ksh75 million, whereas diploma holders can undertake tasks valued between Ksh10 million and Ksh40 million.

For swimming pool construction, only degree holders are qualified for projects exceeding thirty million Kenyan shillings, while diploma holders are limited to projects worth Ksh5 to Ksh15 million.
