A School Fined Sh4.5 Million For Posting Minors’ Picture on Facebook

The Office of the Data Protection Commissioner in Kenya has imposed a fine on an educational institution, Roma School, for failing to comply with the Data Protection Act.

The institution, located in Uthiru, Nairobi, allegedly posted photos of minors without obtaining parental consent, which is a violation of data protection regulations.

In a statement released on Tuesday, Roma School was fined Sh4.5 million for breaching the act. This marks the first and highest penalty imposed on an educational facility for such a violation.

The Data Protection Commissioner emphasized the importance of institutions, especially those handling data related to minors, obtaining consent from parents or guardians before processing such data. This penalty serves as a message to schools and other organizations to adhere to data protection principles and safeguards.

The director of Roma School mentioned that he had not received any complaints about the release of the minors’ images but acknowledged receiving a letter from the data protection office. He expressed a willingness to visit the office of the data protection commissioner to address the matter.

The penalty notices issued by the data commissioner are in accordance with the Data Protection Act of 2019 and related regulations. Data Commissioner Immaculate Kassait urged entities to comply with the Act and ensure that the processing of personal data aligns with its provisions, warning that failure to do so will result in enforcement procedures.
