Government publishes new rules blocking diploma graduates from specific jobs

Lands Cabinet Secretary Zachary Njeru has introduced amendments to the National Construction Authority Act of 2011 that outline guidelines for the registration and engagement of construction technicians in various projects within the construction industry. These amendments aim to align qualifications with project values.

Under the amended regulations, only construction professionals with a bachelor’s degree will be eligible to work on projects exceeding Ksh 750 million. Building contractors with degrees can work on projects valued between Ksh 100 million and Ksh 500 million, while certificate holders will handle projects valued at Ksh 50 million. Those with trade certifications will undertake projects with a value of Ksh 20 million and below.

The objective of these amendments is to update industry practices and standards to reflect current developments in the construction field. The focus will shift towards experience-based evidence for registration, rather than solely relying on document-based criteria, allowing the Authority to assess applicants’ technical competencies.

In the realm of civil engineering works, engineers with a bachelor’s degree will handle projects valued between Ksh 1.2 billion to Ksh 2.5 billion, while diploma holders will be restricted to projects not exceeding Ksh 750 million.

For electrical engineering services, bachelor’s degree holders can work on projects above Ksh 75 million, while diploma holders are limited to projects ranging from Ksh 10 million to Ksh 40 million. In mechanical engineering services, those with bachelor’s degrees can undertake projects above Ksh 75 million, while diploma holders are eligible for projects valued between Ksh 10 million and Ksh 40 million.

In specific cases, such as the construction of swimming pools, only degree holders will be allowed to work on projects above Ksh 30 million, with diploma holders handling projects valued between Ksh 5 million and Ksh 15 million.

It’s important to note that these amendments may impact various individuals in the construction industry, and the public is encouraged to provide their feedback on these proposals within the next 14 days.
